Please read the following terms and conditions very carefully as your use of service is subject to your acceptance of and compliance with the following terms and conditions ("Terms"). JustShop Seller Services Pvt. Ltd. (“JSS”) is the licensed owner of the brand “JustShop24” & “JustShop24.com” and the website JustShop24.com (“The Site”).

 

By subscribing to or using any of our services you agree that you have read, understood and are bound by the Terms, regardless of how you subscribe to or use the services.

 

Service Overview:
The JustShop24 Service is a transaction, information and communication service available to authorized users ("customers") who access JustShop24.com. JustShop24.com currently provides an online grocery shopping and delivery service, and may in the future provide additional shopping and related services. JustShop24.com's employees, agents or designees will shop and deliver grocery orders placed with the JustShop24 Service. Prices of products sold online may differ from those in retail stores. Delivery will be made to the delivery address that you specify when you confirm your order. Prices for products you place in your cart will be guaranteed for the transaction. Payment for groceries and associated shopping and delivery fees is due at the time of delivery. You are responsible for ensuring that someone is present at the delivery address to receive and pay for deliveries at the specified time of delivery. Anyone at the delivery address who receives the delivery is conclusively presumed to be authorized to receive and pay for the order. If JustShop24.com cannot deliver your order, or must make an additional delivery because no one is at the delivery address to receive and pay for the order at the specified time, or wrong address / details given to us by you, will be assessed an additional fee. If you are not satisfied for any reason with an item purchased through the JustShop24 Service, you may call customer service at the time of receiving your order at (033) 60502424. JustShop24.com's liability for missing a delivery is limited to delivery at a later agreed time at no additional charge.

 

(a) Pricing : All the products listed on JustShop24.com will be sold at MRP unless otherwise specified. The prices mentioned on the website are the applicable prices at the time of placing an order. Although prices of most of the products do not fluctuate on a daily basis but some of the commodities and fresh food do change on a daily basis which would be updated almost immediately on the portal. In case the prices are higher or lower on the date of delivery no additional charges will be collected or refunded as the case may be at the time of the delivery of the order.

 

(b) Cancellation Policy : As a policy we do not cancel any order after it has been despatched. As a customer you can cancel your order well in advance before the beginning of the time slot on which you have placed your order. However, if there are changes in the delivery slot time you requested or need to add more products, you need to call us on customer care number (033) 6050 2424. Please note: If we suspect any fraudulent transaction by any customer or any transaction which defies the terms & conditions of using the website, customer misbehavior during delivery or with customer care executives, we at our sole discretion could cancel such orders. We will maintain a negative list of all fraudulent transactions and customers and would deny access to them or cancel any orders placed by them and will block them indefinately.

 

(c) Coupon Discounts : All coupon codes are exclusive  property of JustShop24.com. We reserve the right to cancell or discountinue any coupon code as decided by the management. All coupon codes are subject to following terms and conditions:

1- Only one code can be applied in one transaction.

2- One time and First Purchase codes can only be used only once by a single user and for one delivery address.

3- Free product codes can be used only two times by one user and one delivery address in a month.

4- Certain percentage discount coupon codes have fixed maximum discount per order as indicated against them with an "*" mark.

Current Maximum Discount/ CashBack Limits- Rs 100/ 100 instashop points for all coupon codes in 20% discount category and Rs 100/ 100 instashop points for all codes in 25% category. 

 

(d) Return & Refunds : We have a very flexible return policy which entitles all our members to return the product at the time of delivery if there is a defect in goods, damage in transit, or due to some reason they are not satisfied with the quality or freshness of the product. We will take the returned product back with us and make the necessary adjustments to your order value. However, please note: If a product is returned due to a change in mind and your order value goes below our minimum order requirement of Rs.500, you will be assessed an additional delivery fee.

 

The amount will be refunded to you in the form of JustShop Points which you can use as store credit for future purchases. In case of credit card payments, the money can also be refunded to your account in 8 to 10 working days. Please note: Cash refunds are not a part of our refund policy.

Any other use of materials on JustShop24.com, including, but not limited to, reproduction, modification, distribution or publication for any commercial or public purposes, without the prior written permission of JustShop24.com is strictly prohibited. JustShop24.com reserves the right to revoke this authorization at any time, and any use shall be discontinued immediately on written notice from JustShop24.com.

 

(b) Trademarks : " JustShop24,"  " JustShop24.com,", all JustShop24.com logos, and all titles, characters, names, graphics and button icons are service marks, trademarks and/or trade dress of JustShop24.com or otherwise are proprietary to JustShop24.com and may not be used by you for any reason other than as expressly permitted. All other trademarks, service marks, product names and company names or logos appearing on JustShop24.com are the property of their respective owners.

 

4. Your Account : You agree to provide JustShop24.com with accurate and complete information as required by registration for the  JustShop24 Service ("Customer Registration Data"), including, but not limited to, your legal name, billing and delivery addresses, telephone number and promptly to notify JustShop24.com of any change in your Customer Registration Data at contact@JustShop24.com. Upon registration, your username and password will allow you to access the JustShop24 Service. Your password should be kept strictly confidential to prevent unauthorized use. You agree to notify JustShop24.com promptly of any unauthorized use of your password or your account. You will remain liable for any use of the JustShop24 Service until you notify JustShop24.com of the unauthorized use, loss or theft.

Loyalty Points: Each Loyalty Point is equivalent to one rupee and can be redeemed for shopping on JustShop24.com only. 

However, under any circumstances, JustShop24.com is not liable to refund money to the customer in exchange/return of Loyalty Points. Also, the JustShop Points in an individual account can be used for the same account solely and cannot be transferred to any other account. Loyalty Points will be added to the customer’s account once the transaction for the current bill is completed; which may take about 48 hrs. One can utilize all or part of accumulated point in any of the future transactions. Loyalty points on friends referal will be awarded only if the delivery happens at a new address to which the existing user has referred.

Loyalty points on friends referal will be redeemed only if the delivery happens everytime at a new address to which the existing user has referred.

 

5. Reviews, Comments, Communications, and other Contents : Visitors may post reviews, comments, and other content; and submit suggestions, ideas, comments, questions, or other information, so long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing on intellectual property rights, or otherwise injurious to third parties or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of "spam." You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of a card or other content. JustShop24.com reserves the right (but not the obligation) to remove or edit such content, but does not regularly review posted content.  

(i) You may not post, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information without obtaining the prior written consent of the owner of such proprietary rights.
(ii) JustShop24.com may review, edit, reject, refuse to post and/or delete any Content that in the sole judgment of JustShop24.com violate these Terms of Use or which might be offensive, illegal, or that might violate the rights, harm, or threaten the safety of another person. 
(iii) Any information provided by you on this site shall not be misleading in any way.

 

6. Unauthorized or Fraudulent Use :

JustShop24.com does not offer the JustShop24 Service to children. By registering for the JustShop24 Service, you warrant that you are at least 18 years old. If you are under 18, you may use the JustShop24 a Service only with the involvement of a parent or guardian. From time to time, JustShop24.com may extend promotional offers to existing or potential new customers. You agree to abide by the terms and conditions of any such offer and acknowledge that circumvention of the terms and conditions of such offers constitutes a fraudulent use. You will be liable for damages caused by such fraudulent use.

 

7. Changes in Terms or JustShop24 Service : 

JustShop24.com may at any time change any of the Terms but not limited to, the amount of, or basis for determining, any fees or charges for the JustShop24 Service. If JustShop24.com makes material changes to this Terms, JustShop24.com will provide notice to you in a manner provided in this Terms. Your use of the JustShop24 Service after any such change will be conclusively deemed acceptance of such change. JustShop24.com may discontinue or revise any or all aspects of the JustShop24 Service without prior notice to you. Price and availability of products are also subject to change without notice. We reserve the right to correct online pricing errors. In such event, we reserve the right to correct the pricing error or cancel undelivered orders for such incorrectly priced products. You will be contacted in such circumstances. If any change is unacceptable to you, you may cancel your JustShop24 Service.

 

8. Disclaimer of Warranty and Limitation of Liability : 
Your use of the JustShop24 service, JustShop24.com and the internet is entirely at your own risk. The JustShop24 service, JustShop24.com and its contents are provided on an "as is", "as available" basis. To the fullest extent permitted by law JustShop24.com disclaims all representations and warranties, including, but not limited to, warranties as to the availability, accuracy or content of information, products or services, and warranties of title, non-infringement, merchantability or fitness for a particular purpose. JustShop24.com does not warrant that the functions provided by JustShop24.com will be uninterrupted or error-free, or that JustShop24.com or the server that makes it available are free from viruses or other harmful components. 

Neither JustShop Seller Services nor any of its partners, directors, employees, agents, suppliers, licensors or merchants (collectively, its "associates") shall be liable for damages of any kind, including, but not limited to, direct, indirect, incidental, punitive and consequential damages, arising from your use of, or inability to use, the JustShop24 service, 

JustShop24.com, the internet or for any other claims related in any way to your relationship withJustShop24.com.

 

9. Limitation of Liability

In no event shall JustShop24 or its suppliers, affiliates and service providers be liable for any direct, indirect, incidental, special, incidental, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses arising out of or in connection with the Website, its services or this agreement (however arising, including negligence).

 

JustShop24's liability in any circumstance is limited to the amount of fees, if any, paid by you to JustShop24. 

JustShop24, its associates, affiliates and service providers and technology partners make no representations or Warranties about the accuracy, reliability, completeness, and/or timeliness of any content, information, software, text, graphics, links or communications provided on or through the use of the Website or that the operation of the Website will be error free and/or uninterrupted. Consequently, JustShop24 assumes no liability whatsoever for any monetary or other damage suffered by you on account of: The delay, failure, interruption, or corruption of any data or other information transmitted in connection with use of the Website.

 

Any interruption or errors in the operation of the Website, You expressly understand and agree that JustShop24 shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if JustShop24 has been advised of the possibility of such damages).

 

10. Indemnification :
You agree to defend, indemnify and hold JustShop24.com and its Associates harmless from any claims and expenses, including attorney's fees, arising in connection with a violation of this Agreement by you or through use of your account.

 

11. Termination :
JustShop24.com may suspend or terminate your access to the JustShop24 Service at any time for any reason with or without notice to you. You may terminate your JustShop24 Service at any time for any reason by delivering notice in a manner provided in this Agreement which termination will be effective the day notice is received or such later date specified in the notice.

 

12. Privacy and Security :

(a) Aggregated Information. JustShop24.com may use aggregated information regarding its customers and usage of the JustShop24 Service (such as customer demographics and traffic patterns) and disclose such aggregated information to advertisers, partners and others for various purposes. 
(b) Third Party Service Providers. JustShop24.com may employ other companies and individuals to perform certain functions such as delivering packages and analyzing data. They may have access to personal information to perform their functions.
(c) Sale of Business. JustShop24.com may transfer Customer Registration Data and other personal information in connection with the sale of JustShop24.com or the sale or transfer of its business operations in your geographic area to a third party provider of grocery ordering or delivery services who agrees to be bound by this Privacy Policy until you consent that such information will be governed by the policies and terms of such third party provider.
(d) Enforcement of Agreement or Compliance with Law. JustShop24.com may use or disclose personal information when JustShop24.com believes it is appropriate to enforce this Agreement, to protect the rights, property or safety of JustShop24.com or its users or to comply with the law.

JustShop24.com may give notice and other information to you of a change in this Agreement and any other general matter or products and offer details by general posting on JustShop24.com, by electronic mail, by SMS on your mobile number or by conventional mail to your address contained in the Customer Registration Data.

 

14. Legal and Miscellaneous :
These Terms of Service constitute the entire agreement between the parties with respect to the subject matter hereof and supersedes and replaces all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter. The clauses as above shall survive the termination or expiry of this agreement. This electronic record is generated by a computer system and does not require any physical or digital signatures.

(a) Arbitration
If any dispute arises between you and JustShop24.com during your use of the Website or thereafter, in connection with the validity, interpretation, implementation or alleged breach of any provision of the User Agreement and Terms and Conditions the dispute shall be first referred to a sole Arbitrator who shall be an independent and neutral third party identified by JustShop24.com. The place of arbitration shall be Mumbai. The Arbitration & Conciliation Act, 1996, shall govern the arbitration proceedings. The arbitration proceedings shall be in the English language.

(b) Applicable law
This site is created and controlled by JustShop Seller Services. The laws of India shall apply and courts in Kolkata shall have jurisdiction in respect of all the terms, conditions and disclaimers. JustShop24.com reserves the right to make changes to the website and the terms, conditions and disclaimers at any time and without information to the customers/users of the services/website of JustShop24.com. Users are advised to regularly check for any amendments or updates to the terms and conditions contained herein.
